Description: Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU) The NSSO are currently preparing and finalising the competition documentation for a new MSP competition following the cancelation of the previous competition. To facilitate the continued operation of the MSP for FMSS Wave 1 and ensure that there is no gap in service at the expiry of the existing Agreement, and to allow sufficient time to run the new competition, including evaluation, award of contract and to allow for a transition period from the incumbent provider (if required), the NSSO now wish to extend the Agreement for the provision of the MSP services under the existing Agreement by up to 15 months to the end of December 2025 A change of contractor at this stage, for a contract of 9-15 months duration would impose a significant additional cost on the NSSO and in addition to significant risk that other issues would emerge as the system is used and the other contactor would have to address and as such go beyond providing a managed service, as well as the issue of significant inconvenience arising from delays and disruption for the NSSO’s services to on boarded PSBs if a new contractor had to be sourced and on boarded at this time. In summary, a change of contractor would be completely impractical at this stage due to the increased risks and costs involved. Furthermore, the NSSO will imminently be relaunching the procurement competition for the Managed Service Provider for FMSS. As such, it would not be a rational decision to make this change at this critical point in time.
